Breach Of Contract : Court Refutes Davido’s Preliminary Objection

The Delta State High Court in Effurun has rejected the initial challenge presented by Nigerian-American artist Davido and his company, Davido Music Worldwide Limited, contesting the court’s authority to address the breach of contract lawsuit brought against them by Brownhill Investment Company Limited concerning the annual ‘Warri Again Concert’. 

 

Additionally, Justice Nduka Obi dismissed another objection by Davido Music Worldwide and Israel Afeare, disputing the court’s jurisdiction to hear the defamation case filed against them.

In the case (Suit No. EHC/183/2023) between Brownhill Investment Company Limited and Davido & Davido Music Worldwide Limited regarding breach of contract, the court dismissed the defendants’ claims that the matter was primarily a debt recovery case and premature due to the claimant’s purported failure to issue a letter of demand seeking a refund of the monies claimed in the case.

The court concurred with the claimant’s counsel that the relief sought in the writ of summons must be considered together and not in isolation to determine the nature of the suit.

 

It ruled that the relief sought in the lawsuit clearly indicated that it was a breach of contract action, which did not necessitate the issuance of a letter of demand before filing and/or instituting the lawsuit.

Nevertheless, the claimant noted that no concrete arrangements were made because the defendants wanted the out-of-court settlement to be on their terms, a decision they rejected.

Through its legal representative, Kelechi Onwuegbuchulem, Brownhill Investment Company Limited sought to claim N2 billion in general damages against Davido.
